Design Review Terms of Service

These Terms of Service ("Terms") govern your use of the Design Review feature ("Design Review") provided by Design Master Software, Inc. ("Design Master," "we," "us," or "our") as part of ElectroBIM. By using Design Review, you agree to these Terms.

1. Service Description

Design Review uses artificial intelligence to analyze electrical distribution designs for potential issues. Design Review is a supplementary tool intended to assist qualified professionals by helping identify issues that may warrant further attention. It does not replace the judgment, expertise, or responsibility of a licensed design professional. Design Review does not provide engineering, legal, or regulatory advice. All professional and legal responsibility for design decisions remains with the user.

2. Usage

Design Review is included with your ElectroBIM license at no additional charge. There are no per-use limits. We reserve the right to implement reasonable rate limits or usage thresholds if necessary to maintain service quality for all customers.

3. Acceptable Use

You agree not to use Design Review in any manner that we determine, in our sole discretion, constitutes abuse. Abuse includes but is not limited to: attempting to extract, reverse-engineer, or manipulate the underlying AI prompts or models; using the service to generate content unrelated to electrical design review; submitting data intended to degrade, disrupt, or probe the service; or any use that violates applicable law.

You may not use Design Review in violation of applicable laws or regulations.

We may suspend or terminate access to Design Review for any user we determine is engaging in abusive use.

4. Disclaimer of Warranties

Design Review is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Design Master expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that Design Review will be uninterrupted, error-free, or that any findings will be correct or complete.

AI-generated findings may be incomplete, incorrect, or inapplicable to your specific design conditions. You are solely responsible for independently verifying all findings before relying on them in your work.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Design Master shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Design Review, including but not limited to code violations, design errors, construction defects, regulatory non-compliance, loss of data, loss of revenue, or loss of business opportunity, regardless of the theory of liability.

Design Master's total cumulative liability arising out of or related to Design Review shall not exceed the amount you paid to Design Master for your ElectroBIM license in the twelve (12) months immediately preceding the event giving rise to the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Design Master Software, Inc., its officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of Design Review, including any claim that a design reviewed using Design Review contained errors or did not comply with applicable codes or regulations.

7. Third-Party Services

Design Review depends on third-party services, including AI model providers and cloud infrastructure providers, to function. Design Master does not control these third-party services and makes no guarantee of uptime, availability, or continuity. Design Review may be temporarily unavailable due to third-party outages, maintenance, or changes beyond our control. Design Master is not liable for any interruption or degradation of Design Review caused by third-party services. We do not provide any service level agreement (SLA) or guarantee of uptime, availability, or response time for Design Review.

8. Changes to These Terms

We may update these Terms at any time. Continued use of Design Review after changes are posted constitutes acceptance of the revised Terms.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of Design Review shall be subject to the dispute resolution provisions set forth in your ElectroBIM End User License Agreement (EULA). In the event of any conflict between these Terms and the EULA regarding dispute resolution, the EULA shall control.

10. Term and Termination

Your access to Design Review is contingent upon and coextensive with your active ElectroBIM license. If your ElectroBIM license expires or is terminated for any reason, your right to use Design Review terminates automatically without separate notice.

We may also suspend or terminate your access to Design Review independently if we determine, in our sole discretion, that you have violated these Terms, including the Acceptable Use provisions in Section 3.

Upon termination of your access to Design Review for any reason, Sections 4 (Disclaimer of Warranties), 5 (Limitation of Liability), 6 (Indemnification), and 10 (Governing Law and Dispute Resolution) shall survive and remain in full force and effect.


Design Review Privacy Policy

This Privacy Policy describes how Design Master Software, Inc. ("Design Master," "we," "us," or "our") collects, uses, and stores data when you use the Design Review feature ("Design Review") in ElectroBIM.

1. Data Ownership

You retain full ownership of all design data submitted to Design Review. Design Master does not claim any ownership rights over your data. We use your data solely to provide, maintain, and improve the Design Review service as described in this policy.

2. Data We Collect

When you run a Design Review, ElectroBIM exports a structured text representation of your electrical distribution model and sends it to our servers for processing. You can review exactly what information is sent by using the "Export to AI" command, which generates the same data that is transmitted during the "Design Review" command. It does not include the Revit file itself, drawings, or non-electrical model content.

We also collect limited account and usage information associated with each request, including your license ID, email address, and computer name. This information is used to operate the service, manage access, and help diagnose issues.

3. How Your Data Is Processed

Your design data is sent from our servers to the Anthropic API for AI analysis. Anthropic's use of data submitted through their API is governed by Anthropic's own privacy policy and terms of service, available at anthropic.com/legal/privacy. Per Anthropic's commercial API terms, data submitted through the API is not used to train their models.

4. Data Storage and Retention

We store review requests and responses on Amazon Web Services (AWS) infrastructure. This stored data includes the design data sent for review and the AI-generated findings returned.

We use this stored data for the following limited purposes: debugging errors and service issues; and improving the quality of Design Review (for example, refining review prompts and evaluation criteria). We do not use your data to train AI models, and we do not share your data with third parties except as necessary to process reviews through the Anthropic API as described above.

We retain this data for 30 days, after which it is automatically deleted. AWS's own data handling practices apply to infrastructure-level storage; see aws.amazon.com/privacy.

5. Service Reliability

Design Review may change, be temporarily unavailable, or behave inconsistently. We may modify, suspend, or discontinue any aspect of Design Review at any time without prior notice. Availability does not constitute a commitment to continued availability or any particular level of service.

6. Data Deletion Requests

You may request deletion of your stored review data at any time by contacting us. We will delete the applicable data from our AWS infrastructure within a reasonable timeframe, typically within 7 business days.

7. Security

Data is transmitted using encrypted connections (TLS). Stored data resides in AWS infrastructure with access restricted to authorized Design Master personnel.

8. Changes to This Policy

We may update this Privacy Policy at any time. Continued use of Design Review after changes are posted constitutes acceptance of the revised policy.
